01 Acceptance of Terms

By accessing or using the NetFortify Solutions website (www.netfortifysolutions.com) or by engaging any of our professional IT services, you confirm that:

• You are at least 18 years of age or the age of majority in your jurisdiction.
• You have the legal capacity to enter into binding agreements.
• You have read, understood, and agree to be bound by these Terms.
• Where you act on behalf of an organisation, you have authority to bind that organisation to these Terms.

If you do not agree with any part of these Terms, you must discontinue use of the website and our services immediately.

02 Description of Services

NetFortify Solutions provides a range of professional information technology services, including but not limited to:

• Cloud Computing and cloud infrastructure management
• Cloud Security and managed security services
• Web Development and App Development
• Network Infrastructure design, deployment, and management
• IoT Implementation and integration
• Cybersecurity consulting, assessments, and solutions
• System Migration and digital transformation
• Information Systems consulting and deployment

The specific scope, deliverables, timelines, and fees for any engagement will be agreed in writing through a separate Service Agreement, Statement of Work, or proposal document. These Terms apply alongside and supplement any such engagement-specific agreement.

03 User Obligations

When using our website or services, you agree to:

• Provide accurate, current, and complete information when requested.
• Use the website and our services only for lawful purposes and in a manner consistent with all applicable laws and regulations.
• Not attempt to gain unauthorised access to any portion of our systems, networks, or infrastructure.
• Not use automated tools, bots, scrapers, or similar mechanisms to access or collect data from our website without our prior written consent.

You are granted a limited, non-exclusive, non-transferable licence to access and view the website content for your personal or internal business purposes only. You must not:

• Reproduce, distribute, modify, or create derivative works of any website content without our written permission.
• Remove or alter any copyright, trademark, or other proprietary notices.

Ownership of deliverables developed under a specific service engagement will be set out in the relevant Service Agreement. Unless otherwise agreed in writing, NetFortify Solutions retains ownership of all pre-existing tools, frameworks, methodologies, and intellectual property used in delivering the services.

05 Payment Terms

Fees for professional services are set out in the applicable proposal, quotation, or Service Agreement. Unless otherwise stated:

• Invoices are payable within 30 days of the invoice date.
• All fees are quoted exclusive of applicable taxes (including VAT), which will be added where applicable.
• Late payments may be subject to interest at the rate prescribed by applicable law or as stated in the relevant agreement.
• NetFortify Solutions reserves the right to suspend service delivery in the event of overdue unpaid invoices after reasonable notice.
• Fees paid for services already rendered are non-refundable unless otherwise agreed in writing.

06 Disclaimers

The website and its content are provided on an "as is" and "as available" basis without any warranties of any kind, express or implied. To the fullest extent permitted by law, NetFortify Solutions disclaims all warranties, including:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the website will be error-free, uninterrupted, or free of viruses or harmful components.
• Warranties regarding the accuracy, reliability, or completeness of any information on the website.

Outcomes of professional IT services may depend on factors outside our control, including third-party software, client systems, and network conditions. We do not guarantee specific business outcomes as a result of services delivered.

07 Limitation of Liability

To the maximum extent permitted by applicable law, NetFortify Solutions (Private) Limited and its directors, employees, and contractors shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, goodwill, or business opportunities.
• Damages arising from your reliance on information obtained through our website.
• Damages caused by third-party services, software, or infrastructure that forms part of a solution we deliver.

Where liability cannot be excluded by law, our total aggregate liability to you shall not exceed the total fees paid by you to NetFortify Solutions in the three (3) months immediately preceding the event giving rise to the claim.

08 Third-Party Services

Our website and services may integrate with or reference third-party platforms, tools, and services, including cloud providers, analytics platforms, and productivity software. These third-party services are governed by their own terms and privacy policies.

NetFortify Solutions is not responsible for the availability, accuracy, content, or practices of any third-party website or service. Links to external sites do not constitute endorsement. You access third-party services at your own risk.

If we use sub-contractors or third-party vendors to deliver any portion of our services to you, we remain responsible for ensuring that such delivery meets the standard agreed in your Service Agreement.

09 Termination

NetFortify Solutions reserves the right to terminate or suspend your access to the website or any services at any time, with or without cause and with or without notice, if we reasonably believe you have breached these Terms or any applicable law.

You may terminate ongoing service engagements in accordance with the termination provisions set out in the relevant Service Agreement. Termination of a specific engagement does not affect any accrued payment obligations.

Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) shall survive.

10 Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall first be referred to good-faith negotiation between the parties. If the dispute cannot be resolved within 30 days, it shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

11 Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated Effective Date. Your continued use of the website or our services after the posting of changes constitutes your acceptance of the revised Terms.
